Haranczak vs. Commissioner Tadros
CASE#005-1512-007
FACTS:
1. Mr. Tadros was in
Detroit on Thanksgiving Day to watch the Detroit
Lions. He did not make any picks at the time of
the kick-off of the 1st game on Thursday.
2. Mr. Tadros submitted
his picks at 4:49 pm EST and attached this
statement to his submitted picks:
"I did not do my picks
prior to the kickoff on Thursday. therefore, I
will pick Detroit for the first game. However,
I called Steven Nicolet and Picked Dallas for
the second game prior to kick off, and now I
submit my picks at 4:49 EST. - Thanks"
3. After checking phone
records with Bell South, we discovered that
Peter did in fact place a telephone call to
(919) 338-2063. It was later confirmed that
this is the home residence of Mr. Steven
Nicolet.
4. A deposition took
place yesterday with Mr. Nicolet and under oath
he testified, saying, "Mr. Tadros called me
around 3:30 pm on Thanksgiving Day. Umm..I
don't know? I think it was 3:30...I can't be
certain. I SAID I DO NOT KNOW! For the love of
God...it was between 3:30 and 3:45. Please let
me go home!!"
5. According to the TIME
STAMP on the submitted picks, it was not until
3:52 pm that the first set of picks entered the
database. A second set of picks with Mr.
Tadros' name appeared again at 4:06 pm. the
second set of picks were identical to the first
set. Each time Mr. Tadros' name was typed in
all lower case letters.
The first two sets of
picks (which Mr. Nicolet claims to have
submitted on behalf of Mr. Tadros) had the
following picks: DETROIT, DALLAS and DENVER.
6. Mr. Tadros submitted a
3rd set of picks at 4:49 pm. This time his name
was typed with a capital P and T.
The third set of picks
also had DETROIT, DALLAS and DENVER. Plus he
included all of the rest of the games for week
12.
7. Peter received no
credit for the Detroit game because he knew that
his picks were late. He purposefully picked
Detroit knowing that they were losing or had
lost. He wants full credit for the Dallas game,
because that particular game did not begin until
4:00 pm.
8. If we go by his third
entry of picks, he would not receive credit for
the Dallas game. If we go by the picks that he
called in and Mr. Nicolet entered for him, then
he would receive credit for the Dallas game.
9. Mr. Tadros played
against Mike Colliau in Week 12. Tadros had 12
games correct and Colliau had 13. Tadros
received a loss for Week 12. So no matter what
the verdict is, Tadros already lost that week.
10. The question
is---Should Mr. Tadros go 12-4? Should he go
11-5 by subtracting the Dallas game? Or should
he go 0-16 for submitting late picks?
11. There is a precedent
set by this court a few months ago. The PYX
Constitution under the 12th Amendment clearly
states: "Credit will NOT be granted to any
picks that are submitted after the deadline but
partial credit will be given for games that have
not started/kicked-off."
VERDICT
RENDERED:
I had read the complaint and
hereby render my verdict in the matter. Normally
in a case like this I would make a ruling and
submit it to the Commissioner for a final
ruling. However since the Commissioner is
actually the picker that is being accused of
improper picks,
MY RULING IS FINAL.
I rule in favor of Mr. Tadros in this instance.
I do not believe he intentionally placed
improper picks or he was trying to bend the
rules. I will advise Mr. Tadros that in the
future if he places a phone call to make his
picks, that he go ahead and make ALL remaining
picks by phone.
I believe at the end of this picking season, we
should re-visit the Constitution and make sure
that all of this is covered so we can be clear
about this in the future.
